Drug Conviction on Immigrants Eased with New Bill

Governor Gavin Newsom enacted AB 2195, on fall, to alleviate the challenges faced by immigrants accused of drug-related offenses. The implementation of the Alternate Plea Act aims to provide alternative charges for drug convictions, mitigating the severe immigration consequences for the convicted individuals. Previously, only misdemeanor and felony charges were available. AB 2195 allows the possibility of offering a public nuisance plea to these individuals.

This crucial change has far-reaching implications, as it prevents immigrants from encountering obstacles in accessing housing and employment, as well as avoiding long-term consequences. Given that foreign-born individuals make up 27% of California’s population, this bill is designed to favor marginalized communities and potentially prevent the separation of families.

AB 2195 will come into effect on January 1, 2023. Please note that it does not automatically alter existing charges and must be requested from the District Attorney.

Drug-related charges can carry severe consequences, including imprisonment, substantial fines, and long-lasting impacts on your personal and professional life. Navigating the intricacies of drug laws and building a robust defense is essential for anyone facing such accusations.
