Redland Middle School Teacher Under Arrest for Sexual Allegation with Minors

In June, a 52-year-old middle school teacher was arrested with multiple allegations of child sex crimes in San Bernardino County. The allegations were that Nardella had a longtime sexual relationship with a student that spans more than five years. He was an 8th-grade teacher during the period when the abuse took place.

The charges against Nardella are two counts of sodomy of a person under the age of 16 and two counts of sodomy of a person under 18. Let’s take a look at what this could mean for him.

Sodomy of a minor is a felony offense if it involves anyone under the age of 16, and you could face anywhere from 16 months to 3 years in prison. The act of Sodomy is defined as any sexual penetration, and by itself is not illegal in California. What is illegal is if it’s without consent or the other party is a minor – which is the situation in Nardella’s case.

Now what could make his case worse is if the sexual allegation was also coerced with the use of force or fear. Over the age of 14, if you intimidate a minor into performing sexual acts, it’d fall under California Penal Code 286(c)(2)(c), and you could be sentenced to prison from 7-11 years. Additionally, you’d have to register as a Tier III sex offender. This charge is considered a serious and violent felony crime. Last but not least, you’d receive a Strike on your record under California’s Three Strikes Law.

At the time of this post, Nardella has posted bail and is due to report back in court on August 10th.
